Terms of use

1. The agreement

These terms are between you and the independent developer of Habit Now ("the developer", "I", "me"). Installing or using the app means you accept them. If you don't, the remedy is simple: don't use the app, and delete it if you already have.

Habit Now is distributed through the Apple App Store and Google Play. Their own terms apply alongside these, and where a store's rules conflict with something here, the store's rules win for purchases made through that store.

2. Your licence

You get a personal, non-exclusive, non-transferable, revocable licence to install and use Habit Now on devices you own or control, for your own non-commercial use. That's the whole grant. You may not sell, rent, sublicense or redistribute the app, and you may not reverse-engineer, decompile or extract its assets except where the law expressly says you may regardless of this clause.

3. Accounts

The app works without an account. If you create one, keep your credentials to yourself — you are responsible for what happens under your account. Give a real email address, because it is the only way to recover access or reach you about your data.

You can delete your account at any time by writing to the address at the bottom of this page. I may suspend or delete an account that is being used to attack the service or another user, and will say why unless saying so would defeat the point.

4. Your habits are yours

Everything you put into the app — habit names, notes, your history — belongs to you. No ownership of it is claimed and it is not used to train anything.

The one permission granted is the narrow, boring one needed to run the service you asked for: storing your data, copying it between your own devices when you turn sync on, and passing a summary of it to the AI provider when you ask the coach for a note. That permission ends when you delete your account.

5. Pro subscriptions

Habit Now is free to download and free to use. Pro is an optional paid subscription that adds capacity, history, sync, widgets and the coach's weekly note. The current price is shown in the app before you buy, in your local currency.

• Payment is charged to your App Store or Google Play account at confirmation.
• Subscriptions renew automatically unless you cancel at least 24 hours before the period ends.
• Manage or cancel in your device's subscription settings — not in Habit Now, which cannot cancel on your behalf.
• Cancelling stops the next renewal; Pro keeps working until the paid period runs out.
• If a price changes, you'll be told before it applies to you, and can cancel.

If a Pro subscription lapses, nothing is deleted. Habits beyond the free limit become read-only rather than disappearing, and everything returns the moment you resubscribe.

6. Refunds

Refunds are handled by Apple and Google under their own policies, because they took the payment — I cannot issue one. If a refund is refused and you think the app is genuinely at fault, write to me anyway and I will do what I can.

7. What the coach is not

The weekly note is generated by a large language model reading your habit statistics. It is an observation, not an authority. It can be wrong, it can read a pattern into a coincidence, and its suggestions are suggestions. Treat it as a friendly guess about your data, and use your own judgement about your own life.

8. Not medical advice

Habit Now is a habit tracker, not a medical device or a therapeutic service. Nothing in the app — including anything the tree says — diagnoses, treats or prevents any condition, and none of it replaces a qualified professional. If you are tracking something tied to your health, mental health or a substance you're quitting, talk to someone qualified as well.

9. Acceptable use

Don't:

• Try to break, overload or gain unauthorised access to the app's servers, or to another user's data
• Use the app to store or transmit anything unlawful
• Automate access to the backend, or work around the free-tier limits by technical means
• Strip, hide or alter attribution or licence notices in the app

10. Availability and changes

The app is offered as it is, and it is run by one person. Features may change, sync or the coach may be interrupted, and a service the app depends on may itself go down. Local functionality is designed to keep working offline regardless.

If a feature is ever withdrawn from the paid tier, notice will be given and any prepaid period honoured or refunded. If the service is ever shut down entirely, you'll be given reasonable notice and a way to export your data before it goes.

11. Ownership

The app's code, the tree, its ten stages, the ornaments, the name and the artwork are the developer's property and protected by copyright. Using the app grants you no rights in any of it. Third-party components remain under their own licences.

12. Warranties and liability

Habit Now is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. It is not promised to be uninterrupted, error-free, or to produce any particular result in your life.

To the fullest extent the law allows, the developer is not liable for indirect, incidental, special or consequential damages, nor for lost data or lost profits. Where liability cannot be excluded, it is limited to the greater of the amount you paid for Habit Now in the twelve months before the claim, or ten US dollars.

Some jurisdictions don't allow these exclusions. Where that is so, they don't apply to you, and your statutory rights as a consumer are untouched by anything in this document.

13. Changes to these terms

These terms may be updated. The date at the top will change, and material changes will be announced in the app before taking effect. Continuing to use Habit Now afterwards means you accept the new version.
